Is it ok for me to paint from professional photos as long as I clearly credit the photographer (a box at the bottom with the words "photography by john doe")?

Does is vary? Can I do it if I don't use the art for commercial purposes? Can I use it in my portfolio? Can I use it for commercial purposes (I can guess the answer to that one )? OR does it all come down to getting the express permission of the photographer, for commercial purposes or otherwise?

It's a good bet that if you give proper credit and do not use the work for commercial purposes (unless by prior arrangement with the photographer), you will not have any problems. It's still a good idea to check with the photographer if known...

The only other problem I can envision that may cause a problem is if you use the work in a way that is detrimental to the original photographer's reputation, i.e. clearly distasteful, obscene, pornographic, at complete political or religious odds, etc...
